Wait Time/Downloads/No Shipping for Digital Products: Digital products are available for instant download, & nothing will be shipped physically. Customization turnaround is dependent on booked schedules, client communication, and collaboration. Simpler put: We need payment, assets, and approval to finish. Since we have other clients, you may need a new date if you can’t submit on time.

Licenses for Templates and Brands: We own the intellectual property to the templates and pre-made brands. After purchase, you'll have a use license, but reselling or sharing them is off-limits. Please be kind & keep our site credit in place at the footer.

Customization: 2 revisions are included with your purchase. Additional revisions are charged separately.

Use of Digital Products: Feel free to customize our products for your personal or business use, but sharing with somebody else, reselling it, or any distribution is a no-go.

Deliverables: You only have access to what's clearly spelled out in our agreement. Licensed fonts, images, elements can’t legally be included. Payment must be made before the final files are sent.

Special Note: Since our templates are customizable, they might look similar to others if you choose not to tweak them, but that's all part of the creative process. You can hire us to customize your brand & site, but that’s not included included with your template purchase.

No Communication Policy:

After 30 days without communication from your end, the project will be terminated and considered canceled. While this policy stands, know that I value open dialogue and will always strive to understand and assist you. Communication is key!

Images & Fonts

Deliverables: Just a friendly reminder, you'll only have access to what's clearly spelled out in our agreement. Custom fonts, images, or exclusive access to the template aren't part of the deal. Since our templates are customizable, they might look similar to others if you choose not to tweak them, but that's all part of the creative process.

Images: Sourced from Midjourney, Unsplash, Pexels, Kaboom Pics, and Envato Elements (commercial use and royalty-free for me, but cannot be passed on to you for free usage).

Fonts: We use commercial-free Google fonts frequently. Any custom fonts are sourced from Creative Market, Envato Elements, or the foundry directly, & we're happy to provide links for your purchase.

Licensing

Your purchases grant one (1) revocable, non-transferable, non-exclusive, worldwide license. Client acknowledges that Designer retains all rights to the original design files, interim works-in-progress, underlying code, and tools. You need our written permission outside of personal or business use.

When purchasing services from our site, clients are granted a non-transferable, non-exclusive, worldwide license for the final End Product use. This does not extend to the resale or sharing of these digital products. Our Designer Agreement further details the scope of this license, emphasizing the importance of respecting the intellectual property rights inherent in each purchase.

More simply put? If you resell or give our content away, replicate it for profit, use it many times, or try to pass it off as if it’s yours, you could be subjected to fines and legal action. If you want to reuse the template, you’ll need to purchase new licenses.

Hosting:

The client is solely responsible for acquiring a domain outside of our template purchase or website design service. It is also the client's responsibility to purchase a Showit subscription since our templates are only compatible with the Showit platform. Showit is responsible for hosting all Showit templates, and we do not have any liability for backup, storage, or other services provided by Showit.

We encourage you to review Showit's terms of service here: https://showit.co/terms-of-service/. Following installation, Showit will guide you through blog installation through their Live Chat function.

Revisions:

On top of the original concept that the client purchases, 2 revisions are included with the brand kit personalization package, and the website template customization package, and any further revisions will be charged at a project rate. Payment must be made before the final files are sent. Any changes or revisions made after Client approves the brand overview will be billed separately.

No Refunds:
Please note that all purchases are final and non-refundable, including if you cancel after concepts have been shared. We hate surprises, too, so please make sure you understand before purchase.

Disclaimer: If unforeseen circumstances (like illness) on my part prevent project completion, we’ll issue a refund based on the usability of the work completed thus far. In exceptional circumstances, such as unforeseen illness on the part of the Designer preventing project completion, consideration for a partial refund based on the work completed thus far may be given, consistent with our Designer Agreement.

Wait Time/Downloads/No Shipping for Digital Products:

Digital products are available for instant download, & nothing will be shipped physically.

Timely turnaround for services requires your collaboration. If you're unable to submit your required items, we'll provide you with a schedule to choose the next available date. Remember, the project can't be completed without your payment and active participation, so please ensure you're ready to collaborate! While we'll do our darndest to take care of you ASAP, we must consider the needs of all our clients. If we’re in a busy season, we may be booked out for weeks or months.

Project Suspension:

We value client collaboration, but you hired a designer for a reason. We reserve the right to suspend projects if there is excessive interference, reluctance in final payment, or the client refuses to move forward despite being shown a reasonable number of unique concepts. Fair notice and opportunity to remedy the situation will be provided before any suspension or termination, but no refunds will be issued in these cases.

Pre-made Packages:

When a client purchases a premade or semi-custom brand or logo from our site, they receive a sublicense for the completed End Use. This means they can use the font only for that specific package and not for any other purpose.

By purchasing logo, brand, graphic design, or website design services, the client agrees to this License Agreement and takes responsibility for adhering to it. They must use the End Product in accordance with applicable laws and respect intellectual property rights, or may face monetary fines.

Order
By placing an order, you're offering to purchase the listed products and services under these Terms, but we’re not obligated to accept. All orders must be accepted by us or we will not be obligated to sell the products or services to you.

We might decline orders at our discretion. Once we've reviewed your order, you'll get a confirmation email detailing your order. We aren’t liable for any pricing, typographical, or other errors in any offer, and we reserve the right to cancel any orders that arise from such errors. Only after this email is sent is the purchase agreement between you and Elaborate Daydreams Design, LLC established. Remember, even if you've made a partial payment, no products will be delivered until full payment is received

Pricing:

As such, our packages reflect our care and expertise, and are not negotiable. No services are charged until after we received a signed contract.

Taxes:

The listed prices do not include taxes, but will include charges dependent on your payment choice, & all all applicable taxes and charges will be listed in your shopping cart & order confirmation email.

Payments:

Upon accepting these terms, you grant Elaborate Daydreams Design, LLC and any third-party payment processors authorization to charge your credit card or debit card automatically according to the terms of your payment plan. If your monthly fee payment is declined due to an invalid payment method, you must promptly provide a new eligible payment method or risk having the digital asset removed from your account.

For services purchased directly through our website, clients agree to pay invoices within three (3) days of issuance. Late payments are subject to a fee not exceeding the lesser of 1.5% of the outstanding balance per month or the maximum rate allowed under applicable Michigan laws, aligning with our Designer Agreement's terms.

Deposit

We require a nonrefundable 50% deposit for our services. Your brand assets or website will not be released to you until your payment has been made in full. 

Affiliate Links:

We may choose to provide an affiliate link to products and/or services that we believe align with our own products and/or services from time to time. You understand that we may receive financial compensation or other payment as a result of your purchase of a product and/or service using the link. 

You understand and agree that you must use your own judgment to determine whether to make a purchase using an affiliate link. You agree that we shall have no liability should you choose to make a purchase from an affiliate link and become dissatisfied. You agree to indemnify and hold us harmless should this occur

Information here is believed to be accurate, and we’re not responsible for errors or omissions in our content or materials requested here or via email. Your use of our website and materials is at your own risk, and we're not liable for damage to your computer system or loss of data. The information on our website is provided "as is" without any warranty.

We're not liable for any damages of any kind arising from your use of our website or materials, including indirect, incidental, consequential, or special damages. This Agreement and any disputes arising from it are governed by the laws of the State of Michigan, with arbitration as the preferred method of dispute resolution in accordance with the Commercial Arbitration Rules of the American Arbitration Association. This aligns with the dispute resolution terms outlined in our Designer Agreement. You may be subjected to attorney’s fees and costs. By using our website or materials, you agree to this jurisdiction and waive any defense of forum non conveniens.

You are responsible for defending, indemnifying, and holding Elaborate Daydreams Design, LLC and its affiliates harmless from any claims, demands, or actions arising from your use of our website or materials, including any third-party claims. If we require your assistance in any legal action involving you, you agree to provide us with necessary information at no cost.

Usage of Embedded Assets in Templates:

Non-Extractable Assets: Our templates may include fonts, images, or other design assets sourced from third-party providers, such as Envato Elements. These assets are embedded into our templates in a manner that prevents extraction, repurposing, or direct access to the original asset files.

Limitation on Asset Usage: As a user of our templates, you are granted the right to use these embedded assets within the context of the template. You may adjust the template's design, but you may not extract, repurpose, or use the embedded assets outside of the template or in any other context.

No Redistribution: Redistribution, sharing, or providing access to the original or modified template to third parties, either for free or for purchase, is strictly prohibited.

Licensing Responsibility: While we ensure our usage of third-party assets adheres to the respective licensing terms, it's your responsibility to understand and respect the terms of any additional licenses if you decide to incorporate new assets or modify the existing ones within the template.
